Unlike other states, felonies in Georgia are not divided into "classes" to designate how serious the crime is. Instead, penalties are determined on a crime-by-crime basis. In Georgia, all felony crimes are punishable by a prison sentence of 1 year or more, whereas misdemeanor sentencing is always less than 1 year and only involves county or local jail.

The most serious penalty for a felony crime is the death penalty, which only applies to murder. Kidnapping, armed robbery, and certain sex crimes are punishable by 10-25 years in prison, while certain theft and assault crimes might only carry 1-10 years.

What Is a Wobbler Crime?

In Georgia, if a defendant is convicted of a felony crime that is punishable by imprisonment for 10 years or fewer, the judge has discretion to instead impose penalties as if the crime were a misdemeanor. All felonies with a sentence of 10 years or less are considered "wobblers," for which the judge has discretion to be more lenient if he or she chooses.
