Blood Alcohol Level

Georgia DUI Limit
Under Georgia's DUI laws there are three separate legal limits when it comes to Blood Alcohol Concentration (BAC).
- For driver's under the age of 21, the legal limit is .02%
- For commercial drivers, the legal limit is .04%
- For anyone driving a non-commercial vehicle and over 21 the legal limit is .08%
Is a DUI a Felony or a Misdemeanor?
In Georgia, a DUI (Driving Under the Influence) offense can be charged as either a misdemeanor or a felony, depending on certain circumstances, such as prior convictions, the offense's severity, and any injury or death resulting from the DUI.
A first or second DUI offense within ten years is typically classified as a misdemeanor. A third or subsequent offense, or a DUI resulting in serious injury or death, may be charged as a felony or a high and aggravated misdemeanor. A fourth or subsequent conviction is a felony.
It's important to note that penalties for DUI offenses can vary widely depending on the case's specific circumstances, including the defendant's criminal history, blood alcohol concentration (BAC), and other factors.
In addition to jail time and fines, you may have to complete community service, a substance abuse treatment program, or a clinical evaluation. If a child younger than 14 was in the vehicle, a charge of endangering a child by driving under the influence of alcohol or drugs may be added.
